BY APPLYING TO ATTEND THIS EVENT YOU AGREE TO ALL TERMS CONTAINED IN THIS DOCUMENT. BY ATTENDING THIS EVENT YOU ACKNOWLEDGE THAT YOU HAVE AGREED TO ALL TERMS CONTAINED IN THIS DOCUMENT. 

By applying to attend this event and/or by attending this event you recognize, acknowledge, understand and agree the following: 

•  You will be participating in an activity or activities that may pose danger to your physical well-being and/or health;
• This event involves water, music, crowds, games, alcoholic beverages and/or fireworks; 
• By the very nature of the event and activities included in the event, you are at risk of personal injury, damage or permanent loss;
• You have been advised of the potential risks of attending this event;
• You have full knowledge of the risks involved in activities that will take place at this event;
• You personally assume any and all risks of attending this event;
• You understand that strobe and other fast twitching lights will be used;
• You understand that loud music will be at the event; 
• You assume any expenses that may be incurred in the event of an accident, illness, or other incapacity, regardless of whether you have authorized such expenses;
• You have read all rules, regulations and exceptions concerning this event including this entire waiver and release of liability agreement; and
•  You fully understand all rules, regulations, expectations and terms in relation to the event and agree to be legally bound by them all. 

By applying to attend this event and/or by attending this event you agree to follow and abide by the following rules: 

• You must be at least 18 years of age
• You will provide a government issued photo identification if asked
• You will allow a security search of your bags and any other personal items that you bring to the event
• You consent to have your person searched by security personnel 
• You consent to have your bags, personal items and person searched periodically throughout the event if required 
• NO oversized Purses or Bags (Nothing over 10inches ×10inches or equivalent)
• Any items that have been confiscated from you during a search will not be returned
• Bad, Rude and/or Insulting Attitude will NOT be tolerated
• Improper behavior or vulgar remarks are prohibited
• No crowd surfing, dunking, moshing, or stage diving allowed
• NO illegal substances allowed at event
• NO drugs or drug paraphernalia allowed at event
• NO weapons or items that could be used as weapons are allowed (i.e. combs, picks etc.)
• Security and/or event organizers will make the final call as to what is considered a potential weapon
• NO compressed Gas or Aerosol Canisters allowed
• NO laser pointers, flashlights, or noise-making devices allowed
• NO markers, pens or spray paint allowed
• NO outside food or beverages allowed
• No professional audio, video, or camera equipment (This includes all cameras with Detachable Lenses) allowed
• No type of footwear allowed in the pool
• No throwing of objects of any kind in the pool
• No glass containers or bottles are allowed in or around the pool
• You must use extreme caution and care in and around the pool
• No smoking in the pool
• You will use the pool responsibly. (Lifeguards on duty)
• You will drink responsibly 

By applying to attend this event and/or by attending this event, you acknowledge the many risks associated with this event including but not limited to: 

• The risk of injury resulting from possible malfunction of the pool equipment, water works equipment, and/or fireworks;
• The risk of injuries resulting from tripping or falling over obstacles in the pool area or around the event;
• The risk of injuries resulting from unsupervised divers and swimmers colliding;
• The risk of close contact with other persons due to the large crowds at the event; 
• The risk of other injuries resulting from participating in any action in the pool or other actives at the event; and
• The risk being confronted by a person or persons under the influence of alcohol. 

I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming.

By applying to attend this event and/or by attending this event you further agree to the following conditions: 

• YOU AGREE TO WAIVE ANY AND ALL CLAIMS that you have or may have in the future against the owner(s), promoter(s), its director(s), officers, employees, agents, or representatives of this event relating to your use of the pool and pool area, your consumption of alcohol, and/or your presence on the premises of the event;
• YOU AGREE TO RELEASE the owner(s), promoter(s), its director(s), officers, employees, agents, or representatives of this event from any and all liability for any loss, damage, injury, expense, or other cost that you may suffer or that your next of kin may suffer in connection with your use of the pool or pool area and/or participation in any activities at this event to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF the owner(s), promoter(s), its director(s), officers, employees, agents, or representatives of this event; 
• YOU AGREE TO HOLD HARMLESS AND INDEMNIFY the owner(s), promoter(s), its director(s), officers, employees, agents, or representatives of this event from any and all liability to property, or personal injury to, any third party, resulting from your attendance at this event and/or participation in any activities at this event. 

In addition:

• You certify THAT you are at least 18 years of age, you will drink alcohol responsibly, you will conduct yourself in a peaceful, non-non violent manner and will adhere to all the rules of the event; 
• YOU AGREE that if you break any of the rules contained in this document or if you are found to have breached any terms contained in this document that security or the organizers of the event have the right to remove you from the event without refund of any monies paid. 
• YOU AGREE that if you break any of the rules contained in this document or if you breach any terms in this document, security or the organizers of the event may report you to the police, seek other penal assistance or seek other means of recourse against you. 

Further, YOU AGREE THAT this Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement is fully effective and shall be effective and binding upon you, and your heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on your behalf or on behalf of your estate.

YOU AGREE THAT you have read and understand this document. 

YOU AGREE THAT you are aware that by applying to attend this event, by purchasing a ticket to attend this event or by simply attending this event, you are waiving certain legal rights that you may have against the owner(s), promoter(s), its director(s), officers, employees, agents, or representatives of this event, and you fully agree to do so.
